Welcome to Swirl Hire. These Terms and Conditions govern the use of our services related to career guidance, placement assistance, and professional grooming. By registering with Swirl Hire, you agree to comply with and be bound by the following terms.
1. Definitions
Swirl Hire is the service provider offering career guidance and placement assistance.
Candidate or User refers to any individual registering with the company for placement-related services.
Services refer to career grooming, interview preparation, placement assistance, and job opportunity facilitation provided by the company.
2. Scope of Services
Swirl Hire provides the following services:
- Career counselling and job guidance.
- Resume building and profile optimization.
- Interview preparation and grooming sessions.
- Access to job opportunities through our partner companies.
- Placement assistance until the candidate attends interviews.
The company does not guarantee job placement but commits to providing reasonable assistance and guidance to improve employment opportunities.
3. Registration Fees (Non-Refundable Policy)
The registration fee is strictly non-refundable under any circumstances, including but not limited to:
- Candidate withdrawing voluntarily.
- Candidate failing to attend interviews.
- Candidate declining job offers.
- Failure to secure a job.
4. Placement Success Fee
Upon successful placement of the candidate in any company through the assistance ofSwirl Hire, the amount of the success fee shall be determined and finalized during the discussion between the candidate and Swirl Hire, and the candidate agrees to pay the same.
Payment Terms:
- The success fee must be paid within 7 days of receiving the first salary from the employer.
- Failure to make the payment within the stipulated time may result in legal action and recovery proceedings. It can lead to termination during the probation period in the company in which the candidate is placed.
5. Candidate Responsibilities
The candidate agrees to:
- Provide accurate personal, educational, and professional information.
- Attend scheduled training sessions, interviews, and assessments.
- Maintain professional behaviour during recruitment processes.
- Inform Swirl Hire immediately upon receiving a job offer.
Failure to comply may result in termination of services without refund.
6. No Job Guarantee
Swirl Hire does not guarantee employment. Job offers depend on:
- Candidate performance.
- Employer requirements.
- Market conditions.
- Candidate qualifications and skills.
The company only facilitates opportunities and preparation.
7. Confidentiality and Data Usage
By registering with us, the candidate agrees that:
- Their profile, resume, and personal details may be shared with potential employers.
- The company may store and process personal data for recruitment purposes.
- All personal data will be handled responsibly and securely.
8. Misrepresentation
If a candidate provides false information, fake documents, or misleading details, the company reserves the right to:
- Immediately terminate services.
- Cancel placement assistance.
- Take appropriate legal action if required.
9. Termination of Services
Swirl Hire reserves the right to terminate services if:
- Terms and conditions are violated.
- Candidate behaves unprofessionally.
- Candidate refuses to cooperate during the placement process.
Termination will not entitle the candidate to any refund.
10. Limitation of Liability
Swirl Hire shall not be held responsible for:
- Employment termination by the hiring company.
- Salary disputes between employer and candidate.
- Work conditions or policies of the employer.
- Any indirect losses suffered by the candidate.
11. Intellectual Property
All training materials, resources, and content provided by Swirl Hireremain the intellectual property of the company and must not be reproduced or distributed without written permission.
12. Governing Law
These Terms and Conditions shall be governed by the laws of India. Any disputes arising from these terms shall fall under the jurisdiction of the courts of New Delhi.
13. Offer Rejection & Profile Closure Policy
If the candidate willingly rejects the first offer, we will provide only one more opportunity.
- The second opportunity will only be valid within 6 months from the date of the first placement or offer.
- If the candidate joins a company through our placement process and approaches us again after 6 months, a second chance will not be provided.
- If the candidate rejects the second offer as well, the profile and placement process will be discontinued immediately.
14. Changes to Terms
Swirl Hire reserves the right to modify these Terms and Conditions at any time. Updated versions will be posted on the website. Continued use of services implies acceptance of updated terms.
15. Penalty for Non-Payment
In the event of successful placement through Swirl Hire, the candidate agrees to pay the placement success fee as decided during the discussion. In case of non-payment, a penalty of Rs. 500 per day shall be applicable, and legal action may also be initiated for recovery of dues.
Payment Deadline:
The candidate must pay the placement success fee within 7 days of receiving their first salary from the employer.
Late Payment Penalty:
If the candidate fails to make the payment within the stipulated period:
- A late payment penalty of Rs. 500 per day will be charged until payment is completed.
- If the payment remains unpaid after 30 days, the company reserves the right to initiate legal recovery proceedings, recover the due amount along with penalty charges, legal expenses, and recovery costs, and report the matter to relevant authorities if required.
16. Salary Disclosure Requirement
The candidate must provide salary proof, such as an offer letter or salary slip, upon receiving employment. Failure to disclose accurate salary information will be considered a breach of contract.
17. Binding Agreement
By registering with Swirl Hire, the candidate acknowledges that the success fee payment obligation is legally binding, regardless of whether the candidate continues working in the company after joining.
18. Circumvention Clause
If the candidate receives a job opportunity introduced by Swirl Hire and attempts to bypass the company to avoid paying the success fee, the candidate will still be liable to pay the full placement fee along with a penalty of Rs. 1,00,000 or 3 times the success fee, whichever is higher.
This prevents candidates from contacting the employer directly and avoiding payment.
